Houser/Moore Team Wins Unanimous Federal Court Jury Verdict in Los Angeles

On June 23, 2017, a Los Angeles federal court jury took less than 30 minutes to render a unanimous defense verdict for two of the Firm's clients. The case involved both Federal and State claims for Fair Debt Collection Practice Act violations along with Fraud and Unfair Practice Act claims.

Eric Houser and Ryan Moore took the case over from prior counsel less than 10 weeks before the jury trial and long after all cut off dates had passed. Prior counsel had failed to designate any experts and failed take one of the plaintiff's depositions. The case involved a 14-year history between the borrowers/plaintiffs and complex issues of accounting and collection notices. The borrowers had received over 500 collection letters during the 14 years and disputed their validity. The litigation had been pending 3 years when Houser/Moore trial team took over and delivered the defense verdict. The Judge's comments pulled from the transcript were as follows:

Mr. Houser will be speaking at the Mortgage Bankers Association Legal Issues and Regulatory Compliance Conference on May 7, 2017 in Miami. Mr. Houser will be speaking about the FCRA, FDCPA and the TCPA, including bankruptcy and lien priority disputes.

Eric Houser Chairs the Food from the Bar Campaign for Orange County. Mr. Houser is chairing the Food from the Bar inaugural campaign for the Second Harvest Food Bank in Orange County. The Food from Bar OC involves law firms and other legal associations in Orange County volunteering their time, money and food donations at the Second Harvest Food Bank in Orange County. The campaign runs from May 1, 2017 to June 2, 2017. For those interested in the campaign, please contact Mr. Houser.



Q2 2016 - Ninth Circuit Creates Bright-Line Test for Retroactive Application of TILA Amendments

The Ninth Circuit became the first federal appellate court to reject a claim of retroactive application of Truth In Lending Act 2009 amendments. Talaie v. Wells Fargo Bank, NA, No. 13-56314, 2015 WL 8606014, at *2 (9th Cir. Dec. 14, 2015). here.



October 18, 2016 - SURVIVORS BILL OF RIGHTS: CALIFORNIA’S EXPANSION OF FORECLOSURE PREVENTION RIGHTS TO NON-BORROWERS

In September 2016, California’s Governor, Jerry Brown, signed into law SB 1150, which was enacted to provide protections to surviving spouses and other heirs from alleged abuses by mortgage servicers after the death of a borrower.

Lenders and Servicers have been frustrated with Nevada for the last two years for giving HOA's priority status over secured first liens. This has resulted in substantial losses to the mortgage industry and a windfall to speculators and rent skimmers.

March 4, 2015 - Houser & Allison, APC wins Jury trial in Federal Court on New Arizona Claim

The Firm overcame a hostile media and a new expanded claim under Arizona law to prevail in Federal Court.  The jury reached a 8-0 unanimous defense verdict. The case involved fraud allegations and a new claim in Arizona recognized in 2014 by an Arizona Court of Appeals. The plaintiffs’ “negligent performance of an undertaking” claim had not been previously examined by an Arizona jury. The plaintiffs/borrowers argued that that the defendant loan servicer “instructed” them to default, induced them to apply for a HAMP loan mod, and then negligently processed the application. The newness of the claim resulted in a packed courtroom and a number of articles in print and on the nightly news which unfairly depicted the actual evidence of the case. During the trial, the judge granted the Firm’s motion for judgment as a matter of law on the plaintiffs’ punitive damages claim, but let the remaining claims go to the jury. In the end, by convincing the jury to keep an “open mind” and focus on the evidence, the Houser Firm was able to prevail. The Houser Firm proved that the servicer properly handled the account and complied with Arizona law. The trial was handled by Bob Norman (Los Angeles office) and Sol Krotzer (Phoenix office).

Attorneys Jessica Babine and Chris Cornetta participated as alumni panel members in the Real World Careers event at Boston University’s Center for Career Development. The event gathered an alumni panel to discuss careers in international relations, government and law. The Firm is pleased to announce that it has opened an office in Minnesota. The office is anchored by attorneys, Daniel Sathre and Adam Matheson. Mr. Sathre graduated from the University of Minnesota and obtained his law degree from Notre Dame School of Law. Mr. Matheson graduated from the University of Iowa, Phi Betta Kappa, and obtained his law degree from the University of Minnesota School of Law. Both gentleman clerked for local judges and are Minnesota natives.
